Privacy Policy

PRIVACY POLICY

Entersect is a National Information Service provider.

We offer nonpublic and public information to carefully screened and certified entities that are legally qualified to receive this information under the Gramm-Leach-Bliley Act (GLBA), the Driver’s Privacy Protection Act (DPPA), and the Fair Credit Reporting Act (FCRA), among other applicable state and federal laws.

This Privacy Policy covers Entersect’s website and Entersect’s practices for handling personal information provided to Entersect over the Internet by the public using Entersect’s publicly available website. Entersect will collect, store, and use personally identifiable information only in compliance with applicable laws.

Information Collection

When you browse Entersect’s publicly accessible website, you do so anonymously. Entersect collects personally identifiable information from you only if you choose to provide this information to us. In some instances, Entersect may collect non-personal data (e.g., aggregate or demographic data) through cookies. This information is used to understand better and improve the usability, performance, and effectiveness of the Entersect.com website, as further described below under “Cookies and Tracking Technology”.

The types of personal information we may collect about you through our publicly accessible website include the following (should you decide to provide such information to Entersect): (a) contact and identifying information (e.g., name, address, e-mail address, phone and fax numbers, employer(s), job title) in connection with your expression of interest in receiving information about, or your registering for, Entersect products or services; and (b) any other personal information that you may voluntarily provide to us in an online form or through an e-mail.

Access to certain Entersect web pages and online services is not available to the public and requires a login code and password provided by Entersect. Those web pages and the information downloadable to and from them are available only to Entersect clients. On these web pages, Entersect collects only information that the user voluntarily shares with Entersect.

If you are using this website to open an account with Entersect, we collect the information requested on our account application form, including contact information and financial information (such as credit card number or billing information). This information is used for internal purposes, such as account establishment, billing, order fulfillment, and customer service. We will also request credentialing materials from entities or individuals seeking to use Entersect services and search features to verify their eligibility to access such services and information. This credentialing process is discussed in greater detail in the Entersect User Agreement, which new users must complete before beginning approval and credentialing.

How We Use Your Personal Information

When your personal information is collected on Entersect’s publicly accessible website, Entersect will inform you at the point of collection of the purpose for the collection. Entersect will use your personal information only as specified when it is collected, unless you consent to a different use. For example, Entersect may use personal information submitted in an account application to set up and maintain your account. Entersect may also use the personal information you provide to answer your questions and inquiries.

Information Sharing and Disclosure

Entersect does not sell or rent personal information collected when accessing the Entersect website. Entersect may disclose personal information as necessary or appropriate in connection with any of the purposes for which we use personal information as described above in “How We Use Your Personal Information”.

Entersect also may in good faith disclose personal information and any other additional information available to Entersect for any of the following purposes: (a) investigate, prevent or take action regarding actual or suspected illegal activities or fraud, situations involving potential threats to the physical safety of any person, or violations of Entersect’s terms of use; (b) respond to or defend against subpoenas, court orders, or other legal process; (c) establish or exercise Entersect’s legal rights; or (d) otherwise comply with applicable law.

Entersect may acquire other businesses, and other businesses may acquire Entersect. If that occurs, the information Entersect collects may be one of the assets examined or transferred as part of the transaction. Entersect will not permit another business to examine the information Entersect has collected without a confidentiality agreement and only to the extent permitted by law. Entersect will not transfer the information it has collected unless the recipient agrees to provide privacy protections that are at least as strong as those established by this Privacy Policy.

Cookies and Tracking Technology

Entersect’s website may use the standard technology called a “cookie” to collect information about how you use the website. A cookie is a small data file that is transferred to your hard drive and used for record-keeping purposes. A cookie file can contain information such as the URL you came from, your computer’s IP address (i.e., the Internet address of your computer) and domain type (e.g., .com or .org, etc.), your browser type, the country, state and telephone area code where your server is located, the pages of our site that were viewed during a visit, and any search terms that you entered on our site. This information is used for internal purposes only, and we do not link your URL or IP address to any personal information unless you have logged in to our website with an Entersect account and password.

If you would prefer not to receive cookies, you can configure your browser to refuse them, although some areas of our website may not function properly as a result. You may be required to accept cookies to complete certain actions on Entersect’s website.

Entersect may also use third-party analytics services (such as Google Analytics) to understand how visitors use our website. These providers may set their own cookies; you can learn more and opt out of Google Analytics at https://tools.google.com/dlpage/gaoptout. Entersect honors browser-based privacy signals, including Global Privacy Control (GPC), where required by applicable law, and treats a valid GPC signal as a request to opt out of the sale or sharing of personal information for the browser or device from which it is sent.

SMS Consent and Data Sharing

Entersect strictly protects your SMS data. Text messaging originator opt-in data and consent will not be shared with or sold to any third parties, affiliates, or partners for marketing or promotional purposes.

To stop receiving text messages from Entersect, reply STOP to any message; for help, reply HELP. Your consent to receive text messages is not a condition of purchasing any goods or services. Security

Entersect is committed to protecting the personal information that Entersect receives about consumers. While we cannot guarantee the security of that information, we utilize a combination of online and offline security technologies, procedures, and organizational measures to help safeguard consumer information against loss, misuse, unauthorized access, disclosure, alteration, and destruction. We employ Secure Socket Layer (SSL) data encryption when data is transmitted over the Internet to our website. We have installed layered firewalls and other security technologies to help prevent unauthorized access to our systems. Strong password protection protocols are in place on our computers, and employees are kept up to date on our security and privacy policies. The servers used to store consumer information are maintained in a secure environment with appropriate security measures.

Data Retention

Entersect retains personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, to provide our services, and to comply with our legal, regulatory, tax, accounting, and recordkeeping obligations. Data returned to our clients from searches of GLBA- and DPPA-regulated sources is not retained beyond the period needed to deliver the search results, and in no event longer than seven (7) days, in accordance with our data-provider contracts. As described below, Entersect must retain records of its certified users even after an account is canceled. When personal information is no longer required and we are not legally obligated to retain it, we will securely delete or de-identify it.

Entersect’s website may provide links to third-party websites. Please be aware that those third-party websites are outside of our control and are not covered by this Privacy Policy. If you have questions about how another site uses your information, consult that site’s privacy statement.

Communication

Subscribers agree to receive communication from Entersect via phone, email, or SMS text message about their subscriptions, services, or promotions offered by Entersect and its affiliates. Entersect sends any affiliate promotions on its own behalf and does not share your phone number or SMS opt-in information with affiliates or other third parties for their own marketing purposes.

Your Ability to Review or Modify Personal Information, or Unsubscribe

Entersect strives to protect the quality and integrity of your personal information. If you have provided your personal information (such as zip code, phone, e-mail, or postal address) to Entersect while browsing Entersect’s publicly accessible website and wish to update such personal information (if any) that you have provided us, please e-mail us at customerservice@Entersect.com. Also, if you wish to unsubscribe from any of our communications for which you have registered, you may email us at customerservice@Entersect.com.

If you are an Entersect client with a registered account, you may review (and update) your account information by logging in to your account. Please be advised that Entersect is required to maintain accurate records of its certified users, even after they have canceled their accounts. Entersect is prohibited from removing the account information of its registered users from its database for record-keeping purposes.

You can review a summary of your consumer rights (including file disclosure rights) under the Fair Credit Reporting Act here. Entersect is not a data aggregator and relies on third-party providers to supply the data used by our registered users. Entersect cannot remove your personally identifiable information from the registries accessed through our third-party providers. If you have concerns about your personally identifiable information (PII), you may contact the data aggregators directly at Experian, Equifax, and TransUnion.

California Privacy Rights

This section applies to California residents and supplements the information above. It does not apply to personal information that is collected, maintained, or used subject to the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA), or the Driver’s Privacy Protection Act (DPPA), which is exempt from the California Consumer Privacy Act (CCPA) and is handled in accordance with those laws.

Categories of Personal Information. In the preceding twelve (12) months, Entersect may have collected the following categories of personal information through its publicly accessible website: identifiers (such as name, postal address, email address, and phone number); commercial information (such as account and billing records); internet or network activity (such as IP address and information collected through cookies); professional or employment information (such as employer, job title, and resume information); and inferences drawn from the above.

Your Rights. Subject to certain exceptions, California residents have the right to: (a) know the categories and specific pieces of personal information we have collected; (b) request deletion of personal information; (c) request correction of inaccurate personal information; (d) opt out of the sale or sharing of personal information; and (e) not receive discriminatory treatment for exercising these rights. These rights apply to personal information Entersect collects through its publicly accessible website. Entersect cannot access, delete, correct, or suppress information maintained by its third-party data providers or the registries reached through them; where a verified request concerns that information, Entersect will direct you to the applicable source and, to the extent its provider contracts and applicable law permit, forward your request.

Sale or Sharing. Entersect does not sell or share (as those terms are defined under the CCPA) the personal information it collects through its publicly accessible website. Information furnished to certified users through our third-party data providers is regulated under the GLBA, DPPA, and FCRA, is exempt from the CCPA, and cannot be deleted or suppressed at Entersect’s layer.

Sensitive Personal Information. Entersect does not use or disclose sensitive personal information for purposes that would require an opt-out right under the CCPA.

Exercising Your Rights. To submit a request, email customerservice@Entersect.com or call 1-888-746-3463. We will verify your identity before responding. You may use an authorized agent to submit a request on your behalf; we may require the agent to provide proof of authorization and may require you to verify your identity directly.

Other State Privacy Rights

Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states with comprehensive privacy laws may have rights to access, correct, delete, or obtain a portable copy of their personal information, and to opt out of targeted advertising, the sale of personal information, and certain profiling, to the extent those laws apply and subject to the FCRA, GLBA, and DPPA exemptions described above. As with California residents, these rights apply to information Entersect collects through its publicly accessible website and do not require Entersect to delete, correct, or suppress information maintained by its third-party data providers, which Entersect cannot alter at its own layer. If we deny your request, you may appeal by replying to our response; if your appeal is denied, you may contact your state attorney general.

People Under Age 18

Entersect does not offer services to any person under the age of 18, and this web site is not directed to people under the age of 18. Entersect does not knowingly collect information about people under the age of 18.

Changes to this Privacy Policy

Entersect may revise this policy from time to time. If there is a material change to this Privacy Policy, we will post the revised policy at this location. Entersect will not provide less privacy protection, without your consent, to information collected under a prior privacy policy. We encourage you to periodically review this Privacy Policy to be informed of how Entersect is protecting your information.
